Letter of Understanding (Unofficial translation)

The long struggle between absolute monarchy and democracy in Nepal has now reached a very grave and new turn. Establishing peace by resolving the 10-year old armed conflict through a forward-looking political outlet has become the need of today. Therefore, implementing the concept of absolute democracy through a forward-looking restructuring of the state has become an inevitable need to solve the problems related to class, caste, gender, region etc of all sectors including political, economic, social and cultural, bringing autocratic monarchy to an end and establishing absolute democracy. We make public that, against this existing backdrop and reference in the country, the following understanding has been reached between the seven parliamentary parties and the CPN (Maoist) through different methods of talks.

Points of Understanding

1. Today, democracy, peace, prosperity, social advancement and a free and sovereign Nepal is the chief wish of all Nepalese. We completely agree that autocratic monarchy is the main hurdle in (realising) this. It is our clear view that without establishing absolute democracy by ending autocratic monarchy, there is no possibility of peace, progress and prosperity in the country. Therefore, an understanding has been reached to establish absolute democracy by ending autocratic monarchy, with all forces against the autocratic monarchy centralizing their assault against autocratic monarchy from their respective positions, thereby creating a nationwide storm of democratic protests.

2. The seven agitating parties are fully committed to the fact that only by establishing absolute democracy through the restoration of the Parliament with the force of agitation, forming an all-party government with complete authority, holding elections to a constituent assembly through dialogue and understanding with the Maoists, can the existing conflict in the country be resolved and sovereignty and state power completely transferred to the people. It is the view and commitment of the CPN (Maoist) that the above mentioned goal can be achieved by holding a national political conference of the agitating democratic forces, and through its decision, forming an interim government to hold constituent assembly elections. An understanding has been reached between the agitating seven parties and the CPN (Maoist) to continue dialogue on this procedural work-list and find a common understanding. It has been agreed that the force of people's movement is the only alternative to achieve this.

3. Today, the country has demanded the establishment of permanent peace along with a positive solution to the armed conflict. Therefore, we are committed to ending autocratic monarchy and the existing armed conflict, and establishing permanent peace in the country through constituent assembly elections and forward-looking political outlet. The CPN (Maoist) expresses its commitment to move along the new peaceful political stream through this process. In this very context, an understanding has been reached to keep, during the holding of constituent assembly elections after ending autocratic monarchy, the armed Maoist force and the royal army under the supervision of the United Nations or any other reliable international supervision, to conclude the elections in a free and fair manner and accept the result of the elections. We expect reliable international mediation even during the dialogue process.

4. Expressing clearly and making public institutional commitment to the democratic norms and values like the competitive multiparty system of governance, civil liberties, human rights, the concept of the rule of law, fundamental rights etc, the CPN (Maoist) has expressed commitment to move forward its activities accordingly.

5. The CPN (Maoist) has expressed its commitment to create an environment allowing the political activists of other democratic parties displaced during the course of the armed conflict to return to their former localities and live there with dignity, return their home, land and property seized in an unjust manner and carry out their activities without let or hindrance.

6. Undertaking self criticism and self evaluation of past mistakes, the CPN (Maoist) has expressed commitment not to repeat such mistakes in future.

7. The seven political parties, undertaking self evaluation, have expressed commitment not to repeat the mistakes of the past which were committed while in parliament and in government.

8. In the context of moving the peace process forward, commitment has been expressed to fully respect the norms and values of human rights and press freedom and move ahead accordingly.

9. As the announcement of municipal polls pushed forward with the ill-motive of deluding the people and the international community and giving continuity to the autocratic and illegitimate rule of the King, and the talk of elections to Parliament are a crafty ploy, we announce to actively boycott them and call upon the general public to make such elections a failure.

10. The people and their representative political parties are the real guardians of nationality. Therefore, we are firmly committed to protecting the independence, sovereignty, geographical integrity of the country and national unity. Based on the principle of peaceful co-existence, it is our common obligation to maintain friendly relations with all countries of the world and good-neighbour relationship with neighbouring countries, especially India and China. But we request the patriotic masses to be cautious against the false attempt by the King and (his) loyalists to prolong his autocratic and illegitimate rule and delude the patriotic people by projecting the illusory "Mandale" nationalism and questioning the patriotism of the political parties, and appeal to the international powers and the people to support, in every possible way, the democratic movement against autocratic monarchy in Nepal.

11. We call upon the civil society, professional organizations, various wings of parties, people of all communities and regions, press and intellectuals to actively participate in the peaceful movement launched on the basis of these understandings centered on democracy, peace, prosperity, forward-looking social change and the country's independence, sovereignty, and pride.

12. Regarding the inappropriate conducts that took place between the parties in the past, a common commitment has been expressed to investigate any objection raised by any party over such incidents, take action if found guilty, and to make the action public. An understanding has been reached to settle any problem emerging between the parties through peaceful dialogue at the concerned level or at the leadership level.

 नेपालमा लामो समयदेखि चल्दै आएको निरंकुश राजतन्त्र र लोकतन्त्र ९म्झयअचबअथ० बीचको संघर्ष आज अत्यन्तै गम्भीर र नयाँ मोेेेेडमा पुगेको छ । विगत दश वर्षदेखि जारी सशस्त्र द्वन्द्वको अग्रगामी राजनीतिक निकासद्वारा समाधान गर्दै शान्ति स्थापना गर्न आजको आवश्यकता भएको छ । त्यसैले निरंकुश राजतन्त्रको अन्त्य गरी पूर्ण लोकतन्त्र स्थापना गर्दै राजनीतिक, आर्थिक, सामाजिक, सांस्कृतिक सबै क्षेत्रका वर्गीय, जातीय, लिंगीय, क्षेत्रीय आदि समस्याहरुको समाधान गर्न राज्यको अग्रगामी पुनर्संरचना गर्दै पूर्ण लोकतन्त्रको अवधारणालाई कार्यान्वयन गर्न अपरिहार्य आवश्यकता भएको छ । देशमा विद्यमान उक्त परिप्रेक्ष्य र सन्दर्भमा संसदभित्रका सात राजनीतिक दलहरु र ने.क.पा.-माओवादी) बीच विभिन्न ढंगलेेेे वार्ता भई निम्न प्रकार समझदारी भएको कुरा सार्वजनिक गर्दछौं ।

समझदारी भएका बुँदाहरु

१. आज देशमा लोकतन्त्र, शान्ति, समृद्धि, सामाजिक अग्रगमन तथा स्वतन्त्र सार्वभौम नेपाल आम नेपाली जनताको प्रमुख चाहना हो । त्यसका निम्ति प्रमुख बाधक निरंकुश राजतन्त्र हो भन्ने कुरामा हामी पूर्ण सहमत छौं । निरंकुश राजतन्त्र अन्त्य गरेर पूर्ण लोकतन्त्र स्थापना नगरेसम्म देशमा शान्ति, प्रगति र समृद्धि सम्भव छैन भन्ने हाम्रो स्पष्ट धारणा छ । त्यसैले निरंकुश राजतन्त्रविरोधी सम्पूर्ण शक्तिहरुले निरंकुश राजतन्त्रका विरुद्ध आ-आफ्ना ठाउँबाट प्रहार केन्दि्रत गर्दै देशव्यापी लोकतान्त्रिक आन्दोलनको आँधीबेहरी निर्माण गरेर निरंकुश राजतन्त्रलाई अन्त्य गरी पूर्ण लोकतन्त्र स्थापना गर्ने समझदारी भएको छ ।

२. आन्दोलनको शक्तिले संसद्को पुनस्र्थापन गर्ने र त्यसको निर्णयले अधिकार सम्पन्न सर्वदलीय सरकार, माओवादीसंग वार्ता र सहमतिका आधारमा संविधानसभाको निर्वाचन गरी पूर्ण लोकतन्त्र स्थापना गरेर नै देशमा विद्यमान द्वन्द्वको समाधान गर्न सकिन्छ र सार्वभौमसत्ता र राजकीय सत्ता पूर्णरुपले जनतामा स्थापित गर्न सकिन्छ भन्ने कुरामा आन्दोलनरत सात राजनीतिक दलहरु पूर्ण प्रतिबद्ध छन् । आन्दोलनरत लोकतान्त्रिक शक्तिहरुको राष्ट्रिय राजनीतिक सम्मेलन गर्ने र त्यसको निर्णयले अन्तरिम सरकार बनाई संविधानसभाको निर्वाचन गरेर उल्लेखित लक्ष्य हासिल गर्न सकिन्छ भन्ने ने.क.पा.-माओवादी) को धारणा र प्रतिबद्धता रहेको छ । यो प्रक्रियागत कार्यसूचीको विषयमा आन्दोलनरत सात राजनीतिक दल र ने.क.पा.-माओवादी) बीचमा सम्वाद चलाउँदै जाने र साझा सहमतिको खोजी गर्ने समझदारी बनेको छ । उक्त लक्ष्य हासिल गर्न जनआन्दोलनको शक्ति नै एक मात्र विकल्प हो भन्ने कुरामा समझदारी भएको छ ।

३. देशले आज सशस्त्र द्वन्द्वको सकारात्मक समाधानका साथ स्थायी शान्ति स्थापनाको माग गरेको छ । त्यसैले हामी निरंकुश राजतन्त्रको अन्त्य र उक्त प्रक्रियागत आधारमा आउने संविधानसभाको निर्वाचन र पूर्ण लोकतन्त्र स्थापनाको अग्रगामी राजनीतिक निकासद्वारा देशमा विद्यमान सशस्त्र द्वन्द्वको अन्त्य गरी स्थायी शान्ति स्थापना गर्न दृढ संकल्पित छौं । यस प्रक्रियाद्वारा शान्तिपूर्ण नयाँ राजनैतिक धारमा अघि बढ्न ने.क.पा.-माओवादी) प्रतिबद्धता व्यक्त गर्दछ । यसै सन्दर्भमा निरंकुश राजतन्त्रको अन्त्यपछि हुने संविधानसभाको निर्वाचनको क्रममा माओवादी सशस्त्र शक्ति र शाही सेनालाई संयुक्त राष्ट्रसंघ वा भरपर्दाे अन्तर्राष्ट्रिय सुपरिवेक्षणमा राख्ने, निर्वाचनलाई स्वतन्त्र र निष्पक्ष ढंगले सम्पन्न गर्ने र निर्वाचनको परिणामलाई स्वीकार्ने समझदारी भएको छ । वार्ता प्रक्रियामा समेत भरपर्दाे अन्तर्राष्ट्रिय समुदायको संलग्नतालाई हामी अपेक्षा गर्दछौं ।

४. प्रतिस्पर्धात्मक बहुदलीय शासन प्रणाली, नागरिक स्वतन्त्रता, मानवअधिकार, कानुनी राज्यको अवधारणा, मौलिक हक आदि लोकतान्त्रिक मूल्य मान्यताप्रति ने.क.पा.-माओवादी) ले आफ्नो प्रतिबद्धता प्रस्टताका साथ संस्थागत ढंगले सार्वजनिक गर्दै तदनुरुप आफ्ना गतिविधिहरु अघि बढाउने प्रतिबद्धता व्यक्त गरेको छ ।

६. विगतका गल्ती कमजोरीहरुको आत्मसमीक्षा र आत्मआलोचना गर्दै भविष्यमा गल्ती कमजोरी हुन नदिन ने.क.पा.-माओवादी) ले प्रतिबद्धता व्यक्त गरेको छ ।

७. सात राजनीतिक दलहरुले विगतमा संसद र सरकारमा छँदा भएका गल्ती कमजोरीप्रति आत्मसमीक्षा गर्दै अब त्यस्ता गल्ती कमजोरी नदोहोर्‍याउने प्रतिबद्धता व्यक्त भएको छ ।

८. शान्ति प्रक्रियालाई अघि बढाउने सन्दर्भमा मानवअधिकारका मूल्यमान्यताहरुलाई पूर्ण सम्मान गर्ने र तिनका आधारमा अघि बढ्ने तथा प्रेस स्वतन्त्रताको सम्मान गर्ने कुरा प्रतिबद्धता गरिएको छ ।

९. जनता र अन्तर्राष्ट्रिय समुदायलाई भ्रम दिने तथा राजाको निरंकुश र अवैधानिक शासनलाई वैधानिकता प्रदान गर्ने कुत्सित उद्देश्यका लागि अघि सारिएको नगरपालिकाको निर्वाचनको घोषणा र संसदको निर्वाचनको चर्चा एउटा कपटपूर्ण चाल भएकाले त्यसलाई आ-आफ्नो ढंगले सक्रिय बहिष्कार गर्ने घोषणा गर्दै त्यस्तो निर्वाचनलाई असफल बनाउन आम जनतालाई आह्वान गरिएको छ ।

It may seem strange that on a day when the Congress is debating the budget resolution I would be asking the Senate to turn its attention for a moment to the remote and tiny nation of Nepal.


I do so because for the past several years a ruthless Maoist insurgency and a corrupt, repressive monarchy have brought that impoverished but breathtakingly beautiful country to the brink of disaster. It is important for the Nepalese people to know that while they may live half a world away, the difficulties they are facing have not gone unnoticed by the United States Congress.


It has been almost nine months since Nepalfs King Gyanendra dismissed the multi-party government, suspended civil liberties, and arrested the Prime Minister along with other opposition political leaders, human rights defenders, pro-democracy student activists, and journalists.


The Kingfs explanation was that democracy had failed to solve the Maoist problem. He said that he would take care of it himself and then restore democracy after three years.


It is true that Nepalfs nascent democracy had not solved the Maoist problem. Neither had th e King. In the four and a half years since King Gyanendra assumed the throne and became Commander in Chief of the Nepalese army, the Maoists have grown from a minor irritant to a national menace. While the Maoists use threats and violence to extort money and property, and they abduct children from poor Nepalese villagers, the army often brutalizes those same people for suspicion of supporting the Maoists. Like most armed conflicts, defenseless civilians are caught in the middle.


What the Nepalese people desire most is peace. Despite the Kingfs autocratic maneuvers on February 1, many would have given him the benefit of the doubt if he had a workable plan to quickly end the conflict. Nine months later it is clear that he does not. One can only wonder why King Gyanendra thought that he could defeat the Maoists by dissolving the government, curtailing civil liberties, and surrounding himself with a clique of elderly advisors fro m the discredited, feudalistic Panchayat era.
The United States, Great Britain, and India criticized the Kingfs actions and have urged him to negotiate with Nepalfs political parties to restore democratic government. Unfortunately, although he has released most political prisoners and reinstated some civil liberties, the King has increasingly behaved like a despot who is determined to consolidate his own power.


In the meantime, the Maoists declared a ceasefire. The violence has reportedly decreased, although abductions and extortions have continued apace. Whether the ceasefire is a sinister ploy or a sincere overture for peace may never be known, however, because it is due to expire next month and neither the King nor the army has indicated a willingness to reciprocate.


Against this disheartening backdrop the Congress, on November 10, 2005, approved my amendment to impose n ew restrictions on military aid for Nepal. On November 14, President Bush signed it into law. I want to briefly review what we did, and why.


The amendment says that before the Nepalese army can receive U.S. aid, the Secretary of State must certify that the Government of Nepal has grestored civil liberties, is protecting human rights, and has demonstrated, through dialogue with Nepalfs political parties, a commitment to a clear timetable to restore multi-part democratic government consistent with the 1990 Nepalese Constitution.h


This builds on an amendment that was adopted last year, which required the Secretary of State to certify that the Nepalese army was providing unimpeded access to places of detention and cooperating with the National Human Rights Commission (NHRC) to resolve security related cases of people in custody. Unfortunately, the Secretary was not able to make the certification. Not only were the NHRCfs members replaced through a process that was contrary to Nepalfs Constitution, the International Committee of the Red Cross suspended its visits to military detention centers because it was denied the free access it requires.


The Nepalese Government objects to any conditions on U.S. aid, arguing that the army needs help to fight the Maoists. The army does need help, but it also needs to respect the law and the rights of the Nepalese people. The Congress took this action only after it could no longer ignore the pattern of arbitrary arrests, disappearances, torture and extrajudicial killings by the army. The armyfs abusive conduct, coupled with the Kingfs repressive actions since February 1, have contributed to a political crisis that threatens not only the future of democracy but the monarchy itself.


Economic aid to support health, agriculture, hydropower, and other programs through nongovernme ntal organizations is not affected by my amendment. If the situation changes and the Secretary of State certifies that the conditions in U.S. law have been met, military aid can resume. But that alone will not solve the Maoist problem. The Maoists are expert at intimidating the civilian population and carrying out surprise attacks and melting back into the mountains. While they do not have the strength to defeat the army, neither can they be defeated militarily.


The only feasible solution is through a democratic political process that has the broad support of the Nepalese people. Perhaps seeking to placate his critics, the King, without consulting the political opposition parties, announced municipal elections for February 8, 2006. Not surprisingly, the parties say they will not participate in an electoral process dictated by the palace, and when the army and the Kingfs handpicked representatives have taken contro l of local affairs and are unlikely to relinquish power.


The U.S. Embassy is skeptical of the Maoistsf intentions and has publicly discouraged the political parties from forging an agreement with the Maoists. This is understandable, since the Maoists have used barbaric tactics that should be universally condemned. But this conflict cannot be won militarily and the King has rejected a political accommodation with the countryfs democratic forces. He is imposing new restrictions on the media and civil society, and he has spurned offers by the international community to mediate. Nepalfs younger generation, who see no role for the monarchy in Nepalfs future, are taking to the streets. It may not be long before the army is faced with a fateful choice. Will it continue to side with the palace even if it means turning its weapons on pro-democracy protesters and facing international censure? Or will it cast its lot with the people?


It is a choice that we may also have to make. For the better part of a year, the United States and others friends of Nepal, as well as many brave Nepalese citizens, have tried to nudge the King back toward democracy. It has not worked. With the King increasingly imperious and isolated and the political parties already making overtures to the Maoists, what is to be lost by calling for the Maoists to extend the ceasefire, for the army to reciprocate, for international monitors to verify compliance, and for representatives of all sectors of society who support a democratic, peaceful Nepal to sit down at the negotiating table?

 
There are no guarantees, but it would test the Maoistsf intentions and it might create an opening for agreement on a democratic process, with the support of international mediation, that can finally begin to address the poverty, corruption, discrimination and o ther social ills that have fueled the conflict. The people of Nepal, who for generations have suffered far more than their share of hardship and injustice, deserve no less.

Your Excellency,
I am writing on behalf of the group of donors and U.N. agencies listed below regarding the gCode of Conduct for Social Organization and Associations 2062h which has been promulgated recently by His Majestyfs Government.

 

It is our firm belief that civil society in all countries plays a crucial role in the promotion of democracy, human rights and development. However, in recent months, the international community has become increasingly concerned at the erosion of the rights and freedoms of civil society in Nepal. All governments should provide an enabling environment for the broad participation of civil society in all areas of development, social service provision, humanitarian assistance and human rights, including the right to freedom of association. We believe the gCode of Conducth is not conducive either to improving NGO governance or to fostering NGO endeavors.

 

Moreover, it is inconsistent with Nepalfs commitments and obligations under the international human rights instruments. For example, provisions exerting governmental control over NGO access to funding from international donors, requiring that NGO personnel observe Government policies and bear individual and collective responsibility for the activities implemented by the organization would violate Nepalfs international human rights obligations, including the right to freedom of association.

 

As such, the gCode of Conducth does not appear likely to contribute to the process of ensuring accountability and transparency and will be seen as another step to constrain the legitimate activities of civil society. The regulation of civil society should be the product of an open and active participatory and consultative dialogue and in this instance both the process and the wording have failed to take adequate account of the views of NGOs, both Nepali and international.

 

The donor community believes that the eCode of Conductf clearly provides a means for undue political interference. It is also likely to hinder critical development activities as the independence and impartiality of Non Governmental Organizations are essential to work in rural areas and to support the population affected by the conflict. We therefore recommend that the current eCode of Conductf be withdrawn and that this issue be revisited.

To make the contribution of social organization in the realm of social development more respectable, institutionalized and effective, this Code of Conduct has been prepared and enforced as per the rights enshrined in the Social Welfare Act, 2049 (1992) Article 9 (First Amendment) Ordinance 2062, Clause (l)

 

1. Short Title and Commencement:
1.1 This Code of Conduct shall be called gCode of Conduct for Social Organizations and Institution, 2062h.
1.2 This Code of Conduct shall come into effect immediately.
1.3 This Code of Conduct shall be applicable to social workers of social organizations and institutions functioning within the Kingdom of Nepal.

 

2. Definition:
Unless and otherwise stated differently, in this Code of Conduct, the following shall mean:
ï?· gCouncilh shall mean Social Welfare Council established under Social Welfare Act, 2049.
ï?· gSocial Organization and Institutionh shall mean all the social organizations and institutions which are registered in accordance with the prevailing laws of the Kingdom of Nepal or working under agreement.
ï?· gSocial Worker of social organization and institutionh means patron, executive office bearer, member, staff, worker, advisor, specialist and consultant working in the social organizations and institutions.

 

3. Values and Norms:
3.1 Carry out in a transparent manner the social services without any discrimination on the basis of religion, colour, sex, caste or region.
3.2 Endorse and comply to all commitments made in the bilateral and multilateral agreements to which Nepal is a signatory.
3.3 Social workers shall not undertake bi-partisan political activities within the social organizations they are associated with.

 

4. Priority:
4.1 National and international social organizations and institutions shall give priority to local social organizations and institutions while carrying out the social service activities.
4.2 While selecting such local organizations or institutions objective, competitive and transparent procedure shall be followed in coordination with local government agencies.
4.3 Classes/Communities which need to be protected by the Society shall be given priority for justifiable dignity and service.
4.4 Social organizations and Institutions shall formulate and carry out the programs in consonance with the policy and program as per chalked out by the national and local periodic plan.
4.5 Discourage for not continuing to remain in the Presidency or Chairpersonship in the social organization and institution for more than two consecutive terms and follow the system.

 

5. Transparency:
5.1 All the programmes, activities, financial information and assistance received from internal/external sources shall be presented in a transparent manner.
5.2 Annual progress report and auditorfs report shall be made public in order to ensure that the available financial and other resources received has been utilized for community and social welfare programmes.
5.3 Details of total annual financial transactions shall be submitted in the form of integrated document to the organizationfs management, Council, District Administration Office, District Development Committee and to the donor community as per the necessity.

 

6. Responsibility and Obligation:
6.1 Social workers of the Social Organization shall be fully responsible individually or collectively for activities carried out by the organization.
6.2 They shall be fully responsible to the targeted group.

 

7. Spirit of Volunteerism:
7.1 Officials or members of the organization shall be directed by the inherent spirit of volunteerism.
7.2 Except for reimbursement of expenses incurred during social works, officials or members of the organization shall not draw salary or any allowances and make the organization a source of income.

 

8. Impartiality:
8.1 Social organization and Institutions shall provide services without any discrimination on the basis of religion, colour, sex, caste or region.
8.2 Shall not use financial, material and other resources in activities other than organizational purposes.
8.3 Shall uphold the principle of impartiality as per clause 8.1 in the formation and operation of executive committee of the organization.

 

9. Ethics:
9.1 All officials of social organizations and institutions shall be discouraged to work as salaried residential representatives of international social organization and institutions.
9.2 Due respect shall be given to the needy class and communities which needs social protection and priority given to works that need social service.
9.3 Property of the organization shall not to be used for personal gains.
9.4 Social worker of the social organization and institution shall refrain from:
ï?· Provide false information to any agency.
ï?· Receiving donation, fund and award against organizational or institutional interest.

 

10. Social Goodwill:
ï?· The social worker shall foster social goodwill, co-existence and act for promoting peace.
ï?· Social workers shall not abuse, defame and insult others and refrain from activities that may lead to contempt of court.

 

11. Use of Financial Resources:
11.1 Social organizations and institutions working in Nepal shall not acquire foreign aid earmarked for HMG/N as their source of funding.
11.2 Social organizations and institutions shall have to obtain prior approval of the Council for any bilateral, multilateral, and other corporate assistance for their programmes.
11.3 Social organizations shall make arrangements to provide prior information to local bodies before the implementation of the programmes.


12. Financial Discipline:
ï?· Staff receiving salary from the organization shall not be become either the executive office bearer and member, likewise the executive office bearer and member of the social organization shall not become the paid employee.
ï?· All the capital, properties and other financial resources of the organization shall only be used for social programs and shall not be used for personal advantage of social workers of the organization.
ï?· Annual budget clearly specifying the proportion of program expenditure and administrative expenditure shall be presented.
ï?· Shall prepare a rational standard of remuneration, services, benefits and allowances and programme expenditure in a realistic manner.

 

13. Coordination:
13.1 Necessary contact, cooperation and coordination with HMG/N agencies and local bodies shall be maintained while launching the program.
ï?· Program shall be launched in a coordinated manner avoiding the duplication in local and national level programme.

 

14. Confidentiality:
Confidentiality of all classified information shall be maintained and any such information received by social organizations and institutions must be insured as confidential.

15. Abiding Policy, Program and Code:
Workers of social organizations and institutions shall fully abide by provisions of HMG/N policy, program and code.
